Now 12 is an online fantasy sports business that is considered completely legal in India, apart from a few states. At Now 12, we prioritise user protection so our users can enjoy their favourite sports whilst we take care to abide by all the requisite regulations and legislations in the country.

Indian legislations differentiate between betting on a ‘game of chance’ and putting stakes on a ‘game of skill.’ A ‘game of chance’ entails betting based on sheer luck that is considered to fall under the ambit of gambling and therefore, considered illegal by The Public Gaming Act of 1867 (The PGA). However, in a ‘game of skill,’ as users deploy considerable skill, judgement, knowledge and discretion to create their fantasy teams, it is permitted by the law. Recent court cases in the country questioning the legality of online fantasy sports have also ruled in the favour of the industry, with majority of state legislations permitting engagement in online fantasy sports.

At Now 12, as users are required to use their skills, acumen and attention for selecting teams and participating in contests, the games offered by the platform are based predominantly on ‘skills’ and therefore, considered legal. However, the legal status of online fantasy games is still unclear in a few states, wherein paid skills-based online sports games are considered illegal. These states include, Assam, Odisha and Telangana. States of Nagaland and Sikkim are slightly unique as they permit online games only after securing a due license. As a result, Now 12 currently, does not permit users identified as residents of Assam, Odisha, Nagaland, Sikkim and Telangana to participate in the paid contest(s) organized by the platform. We continue to keep a close watch on the evolving legal landscape of online fantasy sports in India and will make changes to the playing conditions in future as required by the state legislations to facilitate a seamless gaming experience for our users.
